Episode 3 - Then-Existing Mental State: "I'm DONE with him... I swear!"
The oak tree was giving shade, but the gossip. The gossip was giving LIFE.
By the time the four best friends gathered again — Maya, Jules, Trevor, and Lena — the whole campus seemed to hum with whispers about Marcus and Talia. Even the squirrels looked like they were eaves dropping.
Trevor sat down dramatically, dropping his backpack like it weighed 200 pounds.
"I have more," he announced.
Maya raised an eyebrow. "Trevor... how much did you witness? Were you basically the unofficial third roommate?"
Trevor waved her off. "Listen. When the police finally showed up, Marcus was outside pacing like he was trying to burn a hole in the sidewalk. And he was saying the wildest stuff."
Lean leaned in. "What did he say?"
Trevor took a breath, then imitated Marcus with surprising accuracy:
"He kept saying, "I'm DONE. I'm SO done. I can't take this anymore. I'm leaving tonight."
Jules blinked. "He said all that? Out loud?"
Trevor nodded. "Oh yeah. And he wasn't saying it to anyone in particular. He was just... talking. Like his feelings were spilling out of him."
Maya scribbled something in her notebook. "That's important."
Trevor continued, warming up:
"And Talia. She was inside crying, telling the officer, "I'm scared he's going to leave. I don't want him to go. I love him, but he doesn't listen."
Lena clutched her chest. "Oh my gosh... that's heartbreaking."
Jules sighed. "So, they were both just... emotionally exposed."
Trevor nodded. "Exactly. They weren't explaining the past. They weren't telling a story. They were just saying how they felt right then."
Let us put the pieces together:
Maya tapped her notebook again, the unofficial professor of the group.
"Guys... this is Then-Existing Mental State."
Everyone stared.
She explained:
"When someone says how they feel — right now, in the moment — the law sometimes lets that in as evidence. Because feelings aren't usually planned or rehearsed. They just... happen."
Trevor nodded. "Marcus wasn't trying to convince anyone. He was just mad. And Talia wasn't trying to build a case. She was scared."
May smiled. "Exactly. The law says statements about your current feelings, current intentions, or current state of mind can be used to show what you were thinking or planning."
Jules pointed at Trevor.
"So, Marcus saying "I'm leaving tonight" could be used to show he intended to leave."
Lena added, "And Talia saying, "I'm scared he'll leave" shows her emotional state."
Trevor raised his iced coffee like a judge's gavel.
"Ladies and gentleman... their feelings are evidence."
Doctrine:
Then-Existing Mental State = Someone expressing their current feelings, emotions, or intentions.
Not past. Not future.
Just what's happening inside their heart or mind right now.
Just like Marcus pacing and declaring he was "done," and Talia crying that she didn't want him to leave.
